These Terms & Conditions ("Terms") govern your use of the ReelKatha platform at reelkatha.com, operated by 10Fold AI Solutions("we", "us", or "our"), a company registered in India. By accessing or using ReelKatha, you agree to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree to any of these, please do not use the platform.

1. Eligibility

• You must be at least 18 years of age to use ReelKatha independently.
• Users between 13 and 18 years of age may use ReelKatha only with verifiable consent from a parent or legal guardian, in accordance with the Digital Personal Data Protection Act, 2023.
• Users below 13 years of age are not permitted to use the platform.
• By using our services, you represent and warrant that you meet these eligibility requirements.

2. Account & Authentication

• You register and log in using your mobile phone number via OTP verification.
• You are responsible for maintaining the security of your phone number and account. Any activity under your account is your responsibility.
• You agree not to share your account or OTP codes with others.
• You must not create multiple accounts to circumvent usage limits, bans, or credit limits.
• We reserve the right to suspend or terminate accounts that violate these Terms, with notice where practicable.

3. Services

ReelKatha is an AI-powered video reel generation platform. You provide a text idea or prompt, and our platform generates a complete video reel including script, visuals, voiceover, captions, and background music.

• Generated content quality depends on the AI models and may vary between generations.
• We do not guarantee that generated content will be error-free, factually accurate, or suitable for any specific purpose.
• AI-generated content may inadvertently contain inaccurate information, biased outputs, or content that resembles existing works. You are responsible for reviewing content before publishing.
• Service availability is subject to maintenance, updates, and technical limitations.

4. Credits & Payments

• Video generation requires credits, which can be purchased through the platform.
• New users receive free credits as specified on the platform at the time of signup. Free credits have no monetary value and cannot be refunded or converted to cash.
• Credits are non-transferable and linked to your account.
• Purchased credits do not expire unless your account is terminated for violation of these Terms.
• All payments are processed securely through Cashfree Payments, a PCI-DSS compliant payment gateway. We do not store your card or bank details.
• Prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes.
• We reserve the right to change credit pricing at any time. Price changes will not affect credits already purchased.

5. Refund Policy

• If a video generation fails due to a platform error, the credits consumed will be automatically refunded to your account balance.
• Purchased credits are generally non-refundable as they constitute digital goods delivered instantly upon purchase.
• Refunds may be granted for duplicate charges, undelivered credits, unauthorised payments, or extended platform unavailability.

• Refund requests can be sent to 10foldaisolutions@gmail.com.
• Nothing in this section limits your rights under the Consumer Protection Act, 2019, or any other applicable consumer protection law.

6. Content Ownership & License

• Your content: Videos generated using your prompts belong to you. You may download, share, and use them freely on any platform, including for commercial purposes.
• Our platform: The ReelKatha platform, its design, code, AI models, and branding remain our intellectual property. Nothing in these Terms grants you rights to our trademarks, logos, or brand assets.
• License to us: By using our platform, you grant us a limited, non-exclusive license to process your prompts and store generated content for the purpose of service delivery, project history, and re-editing capabilities.
• AI-generated content disclaimer: Content is generated using third-party AI models. We do not claim ownership of AI-generated outputs. However:
  • AI outputs may inadvertently resemble existing copyrighted works, trademarks, or recognisable likenesses of real individuals
  • We cannot guarantee that generated content does not infringe upon any third-party intellectual property rights
  • You are solely responsible for ensuring that your use of generated content complies with applicable copyright, trademark, personality rights, and right-to-publicity laws
  • You must not use generated content to create false or misleading representations of real events, individuals, or organisations

7. Acceptable Use

You agree not to use ReelKatha to:

• Generate content that is illegal, harmful, threatening, abusive, defamatory, or obscene
• Create deepfakes or manipulated media depicting real individuals without their explicit written consent. Note: Creating and distributing deepfakes may constitute a criminal offence under Section 66D of the IT Act, 2000, and may attract penalties under the IT (Intermediary Guidelines) Rules, 2021
• Generate content that promotes violence, hatred, discrimination, or communal disharmony
• Create content that could constitute misinformation or disinformation, particularly related to elections, public health, or national security
• Generate sexually explicit content, child sexual abuse material (CSAM), or content that sexualises minors in any form
• Circumvent safety filters or content moderation systems
• Use automated tools, bots, or scripts to access the platform beyond normal usage
• Attempt to reverse-engineer, decompile, or extract our AI models or proprietary systems
• Resell or redistribute the platform's services without authorization
• Use the platform in any manner that violates applicable laws, including but not limited to the IT Act 2000, IPC/BNS provisions, and the Consumer Protection Act 2019

We reserve the right to remove content and suspend accounts that violate these guidelines, without prior notice where the violation is severe. We may also report illegal content to law enforcement authorities as required by law.

8. Limitation of Liability

• ReelKatha is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant uninterrupted, error-free, or secure operation of the platform.
• We are not liable for any content generated by AI models, including content that may be inaccurate, biased, offensive, or infringing. You use AI-generated outputs at your own risk and discretion.
• To the maximum extent permitted by law, our total aggregate liability shall not exceed the amount you actually paid to us in the preceding 12 months, or INR 5,000, whichever is lower.
• We shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the platform, including but not limited to loss of profits, data, goodwill, or reputation.
• Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Indian law, including the Consumer Protection Act, 2019.

9. Indemnification

You agree to indemnify and hold harmless 10Fold AI Solutions, its founders, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising from:

• Your use of the platform or any content you generate, publish, or distribute using ReelKatha
• Your violation of these Terms or any applicable law
• Your infringement of any third-party intellectual property, privacy, or personality rights through use of generated content
• Any third-party claims arising from content you created using our platform

10. Modifications

• We may update these Terms at any time. Changes will be posted on this page with an updated date.
• For material changes that significantly affect your rights or obligations, we will make reasonable efforts to provide advance notice (e.g., via a prominent notice on the platform).
• Continued use of the platform after changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the platform.
• We may also modify, suspend, or discontinue any part of the service at any time, with reasonable notice where practicable.

11. Dispute Resolution

• Informal resolution: Before initiating any formal proceedings, you agree to first contact us at 10foldaisolutions@gmail.com and attempt to resolve the dispute informally within 30 days.
• Arbitration: If informal resolution fails, any dispute arising out of or in connection with these Terms shall be settled by binding arbitration under the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator mutually appointed by the parties. The seat of arbitration shall be New Delhi, India, and proceedings shall be conducted in English.
• Consumer forum rights: Nothing in this arbitration clause restricts your right to approach any consumer forum or consumer dispute redressal commission under the Consumer Protection Act, 2019.
• Injunctive relief: Either party may seek injunctive or other equitable relief from any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

12. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, including but not limited to the Information Technology Act, 2000, the Consumer Protection Act, 2019, the Digital Personal Data Protection Act, 2023, and the Indian Contract Act, 1872. Subject to the dispute resolution mechanism in Section 11, any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

In accordance with the Information Technology Act, 2000, the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Digital Personal Data Protection Act, 2023, the Grievance Officer for the purpose of these Terms is:

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and 10Fold AI Solutions regarding your use of ReelKatha, and supersede any prior agreements or understandings.
